Real Estate Development & Land Use Regulation

Edward S. Hill provides legal counsel and representation through all stages of real estate development:  analysis of land use regulatory constraints; other due diligence;  evaluation of opportunities for negotiation of special zoning regulations to enhance the development potential of the property; drafting and advocating for the adoption of the special regulations; general representation to obtain inland wetlands, planning and zoning, zoning board of appeals, historic district commission, and other necessary land use regulatory approvals; and structure of the form of ownership and operation of the property.  He also represents property owners in defending against land use approvals that would adversely impact their properties. 

His years of experience with land use regulation enable him to understand and work with the informal procedures and regulatory interpretations.  Mr. Hill’s extensive background in real estate transactions and finance enables him to deal with regulatory requirements and the structure of approval conditions in a way that preserves and enhances the feasibility of the contemplated development.

Representative Development and Land Use Matters:

  • Disposition by liquidating trust of approximately 1,100 acres of land abutting Lake Quassapaug in Middlebury, Connecticut.  To facilitate that disposition developed and won approval of special zoning regulations to allow diverse uses of the property for a cottage community, boating and fishing clubs, single-family residential development, and open space and conservation purposes.
  • Obtained zone change and land use approvals for construction of an approximately 45,000 square foot warehouse/office flex building in Cheshire, Connecticut, represented owner in construction and permanent financing of the project (and later modifications of the financing terms) and negotiation of lease with major pharmaceutical company for almost all of the space in the building.
  • Obtained variances to allow division and sale of obsolete portions of manufacturing facility in New Milford, Connecticut.
  • Land use approvals, acquisition and construction financing, condominium documentation for 48-unit suburban condominium complex (Southbury), and a 27-unit detached cluster planned common interest ownership community (Middlebury) requiring, in each of the towns, negotiating, drafting and gaining approval of special zoning regulations to allow the projects.
  • Land use approvals and property acquisition for expansion of shopping center in Cheshire, Connecticut for replacement of 38,000-square-foot supermarket with new 64,000-square-foot facility, requiring obtaining discontinuance and conveyance of town road from the municipality and easement rights for additional shopping center access.
  • Land use approvals for fueling facility in Cheshire, Connecticut.
  • Directed the land use approval and permitting for the major redevelopment by City of Bridgeport for the Harbor Yard baseball stadium and arena.
  • Drafted and obtained approval of a special district regulation in Meriden, Connecticut to allow adaptive reuse and preservation of an historic mansion and estate.
  • Represented City of Hartford in negotiation and implementation of redevelopment agreement and long-term space lease by the City of Hartford for the redevelopment of the retail, office, and parking components of the Hartford Civic Center, requiring negotiation and implementation of tax-fixing agreement, resolution of title issues, and modification and update of lease for operation of coliseum and exhibition hall.
  • Represented University of Hartford in negotiation of tax increment financing arrangement in support of new performing arts center.
  • Real estate counsel for the Storrs Center development, Mansfield, Connecticut, a $200 million mixed-use development adjacent to the main campus of the University of Connecticut.
  • Inland wetlands, subdivision and other approvals for residential subdivisions.
